Terms & Conditions

Legal and Tax Compliance

ELHATI SURF fully complies with all applicable tax and legal obligations. We confirm that our company does not engage in any form of tax evasion and we are committed to operating transparently and in full compliance with local and international tax laws.

As a responsible business, we ensure that we adhere to all relevant fiscal regulations and contribute fairly to the funding of public services and the local economy.

Surf lessons and coaching

Surf & Stay packages

Accommodation at the hostel

Other related activities and services

All services are subject to availability, and bookings are confirmed only after payment of a deposit equal to 30% of the total service amount, unless otherwise expressly agreed in writing.

Bookings & Payments

Booking requests may be submitted through the website using the contact or quote request form, or directly via email, WhatsApp, or through the official social media channels of ELHATI SURF.

A partial payment (deposit) is required to confirm a booking. The deposit is set at 30% of the total service amount.

Payments can be made by the following methods: bank transfer, Revolut, Wero, or any other method accepted by ELHATI SURF.

The remaining balance must be paid on the day of the service or at the start of the stay.

Cancellations & Refunds

All cancellations must be communicated in writing to elhatisurf@gmail.com, or via the official WhatsApp of the company at +212 601-407457 (with a read receipt requested). For any cancellation made more than 30 days before the departure, no fees will be applied and the 30% deposit will be fully refunded. However, for any cancellation less than 30 days before the departure, our standard cancellation policy applies: the 30% deposit remains non-refundable, and no refund will be provided for unused services or early departure. If ELHATI SURF cancels the service due to reasons beyond the client’s control (e.g., overbooking, safety conditions, force majeure), the deposit will be fully refunded. In case of force majeure, the deposit will also be refunded if the event lasts for more than 30 consecutive days.

Age and Minors

ELHAT SURF welcomes clients of all ages, including minors.

Minors must be accompanied by a parent or legal guardian, unless a specific written agreement has been made with ELATI SURF.

This rule applies to all services and activities offered by ELHATI SURF, including surf lessons, “surf & stay” packages, and accommodation in the hostel.

Even if minors are supervised by the team during lessons or activities, they remain under the full responsibility of their parents or legal guardians.

Parents or legal guardians are responsible for ensuring that safety instructions are followed and for the behavior of their children during the stay or service.

Liability and Insurance

Clients are responsible for their personal belongings during their stay or participation in activities. ELHATI SURF is not liable for any loss, theft, or damage to personal property.

ELHATI SURF takes all reasonable measures to ensure client safety during activities, but cannot be held liable for accidents or injuries occurring during surf lessons, activities, or the stay, except in cases of proven negligence by the company.

Clients participate in activities at their own risk. It is recommended to have personal insurance covering accidents, illness, and property damage during the stay.

Parents or legal guardians are responsible for the safety and behavior of minors during activities and the stay.

Specific Terms for Offers

Surf Lessons:
Participation in surf lessons is subject to the mandatory requirement of knowing how to swim for safety reasons. ELHATI SURF provides the necessary equipment, but participants may bring their own wetsuit. If a participant wishes to bring their own surfboard, prior approval must be obtained from ELHATI SURF via WhatsApp to ensure compatibility with the participant’s surfing level.

Surf & Stay Offers:
Accommodation bookings for this offer can be made up to 3 days prior to arrival.
The room type will be allocated based on availability. Clients must notify any allergies, medical conditions, and specify their dietary preferences before arrival so that meals can be adjusted accordingly.

Group Offers:
For group bookings from 6 people, special rates may apply. Group bookings must be made at least 15 days prior to the planned arrival date. A 30% deposit is required to secure the booking. Modifications or cancellations must be made at least 7 days before the arrival date.

Force Majeure and Weather Conditions

ELHATI SURF will not be held liable for any failure to perform its obligations under these Terms and Conditions in the event of circumstances beyond its control, including but not limited to: natural disasters (such as earthquakes, floods, storms), wars, riots, acts of terrorism, strikes, epidemics, pandemics, fires, transport blockages, network outages, or any other exceptional situation making the performance of its services impossible or unsafe.

Regarding surf activities, ELHATI SURF reserves the right to cancel or modify such activities if the weather conditions are deemed dangerous or unsuitable, such as in
the case of strong winds, storms, excessive waves, or other risky marine conditions. Client safety being the absolute priority, any activity deemed too dangerous will be rescheduled or cancelled.

In case of force majeure, ELHATI SURF may suspend the execution of its services during the duration of the force majeure event and, where possible, will offer an alternative (such as rescheduling or other solutions) to the affected clients.

If the force majeure event lasts for more than 30 consecutive days, ELHATI SURF reserves the right to cancel the service, in which case the deposit already paid will be fully refunded.

Neither party shall be held liable for failure to fulfill its contractual obligations if the failure is due to a force majeure event.

Intellectual Property

ELHATI SURF is a registered trademark with the relevant authorities, and all associated elements such as the logo, images, texts, graphics, videos, user interface content, design, structure of the website, as well as the content on ELHATI SURF’s official social media channels, are the exclusive property of ELHATI SURF. Any reproduction, distribution, modification, publication, or exploitation of these elements, in whole or in part, is strictly prohibited without the prior written permission of ELHATI SURF.

The ELHATI SURF website was created internally by the ELHATI SURF team and is protected by copyright and database rights. No content from the website may be copied, reproduced, distributed, transmitted, or used in any way without the express prior consent of ELHATI SURF.

ELHATI SURF reserves the right to pursue any individual or entity that violates these provisions through legal means for any infringement of its intellectual property rights.

Use of the website or services provided by ELHATI SURF does not grant any right, title, or interest in the intellectual property elements.

All content published on ELHATI SURF’s official social media channels (images, videos, texts, etc.) is also the exclusive property of ELHATI SURF. Only our clients and partners are allowed to reuse this content to promote ELHATI SURF on their own social media profiles or websites, and only after obtaining prior written authorization from ELHATI SURF. Any other unauthorized use is strictly prohibited.

Environmental Impact of Travel

Transportation to our Surf Camp in Tamraght is a significant factor in the carbon footprint of your trip. Below is an estimate of the greenhouse gas (GHG) emissions associated with various modes of transport:

Plane (Paris – Agadir): Approximately 300 kg CO2 per passenger (one-way).

Car + Ferry (Paris – Agadir via Tarifa): Approximately 194 kg CO2 per passenger (one-way).

These estimates are provided for informational purposes and may vary depending on several factors, including the type of vehicle, specific travel conditions, and route taken.

We strongly encourage our clients to consider more environmentally friendly travel options whenever possible. By making responsible choices, we can collectively minimize the environmental impact of your journey while ensuring an enriching and memorable experience.

Waste Management and Zero Plastic Policy

As part of our commitment to environmental responsibility, ELHATI SURF has implemented a proactive Zero Plastic policy at our Surf Camp in Tamraght. We strive to reduce waste production and promote the use of sustainable alternatives, while ensuring the health and comfort of our clients.

Key Initiatives:

Elimination of Single-Use Plastics: We have eliminated all single-use plastics from our operations, including plastic bottles, straws, and packaging. However, for health and safety reasons, we provide recycled plastic water bottles before each activity (surf, excursions, etc.) to ensure safe drinking water while minimizing our ecological footprint.

Waste Sorting and Recycling: We actively sort and recycle all waste produced at the Surf Camp to ensure proper disposal and minimize landfill impact. Recycling stations are available throughout the camp to facilitate this process.

Sustainable Alternatives: Whenever possible, we prioritize the use of eco-friendly products, such as biodegradable or reusable items, particularly in our catering and service areas.

Client Awareness: We encourage our clients to actively participate in our sustainability efforts by using reusable containers, minimizing waste, and recycling during their stay. We also conduct awareness actions to highlight the environmental impact of each individual gesture.

Changes to Terms & Conditions

ELHATI SURF reserves the right to modify, update, or amend these Terms and Conditions at any time, in particular to comply with applicable laws or improve the service.

Changes will be published on the website and will take effect immediately upon publication.

It is the responsibility of clients to regularly review the Terms and Conditions to stay informed of any changes.

Booking or using the services after publication of the changes constitutes full acceptance of the updated terms.
